By downloading, accessing, or using the Loomy app (“the App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
You must be at least 13 years old (or the age of digital consent where you live) to use the App. During the beta period, access also requires a valid invitation code.
The App is provided as early-access / beta software. It may contain bugs, may change or be discontinued at any time, and features may be added or removed. Back up anything important (the App includes an export feature). We are not liable for lost or corrupted data.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use.
You retain all rights to the journal entries, photos, recordings, and other content you create in the App (“Your Content”). We claim no ownership of Your Content. Because the App is local-first, Your Content is stored on your device; we do not host or access it. You are responsible for Your Content and for keeping your own backups.
When you use an AI feature, you direct us to transmit the relevant content to our AI provider to generate a result, as described in the Privacy Policy.
You agree not to: use the App for any unlawful purpose; attempt to breach, probe, or overload the App or our proxy/servers; reverse engineer the App except to the extent that restriction is prohibited by law; or use the App to create content that is illegal or infringes others' rights.
The App can connect to third-party services (including Google, Whoop, Oura, Apple Health, Open-Meteo, Stadia Maps, and your device platform). Your use of those services is governed by their terms and privacy policies, and we are not responsible for them. Availability of those integrations may change outside our control.
AI-generated summaries, transcriptions, images, insights, and health reports are produced by automated models and may be inaccurate, incomplete, or misleading. They are provided for personal reflection and convenience only. Do not rely on them as fact, and always review them.
Loomy is a journaling and wellness app, not a medical device. It does not diagnose, treat, cure, or prevent any condition, and nothing in the App — including health metrics, scores, correlations, or AI reports — is medical, clinical, or mental-health advice. Consult a qualified professional for any health concern, and call your local emergency number in an emergency.
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or that the App will be uninterrupted or error-free, to the fullest extent permitted by law.
To the fullest extent permitted by law, the provider will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the App. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid for the App (if any) or USD $50.
You agree to indemnify and hold harmless the provider from claims arising out of your misuse of the App or your violation of these Terms, to the extent permitted by law.
You may stop using the App and delete it at any time. We may suspend or end your access (for example, by ending the beta) at any time. Sections that by their nature should survive termination (e.g. 4, 7–11) will survive.
We may update these Terms. Material changes will be reflected by a new effective date and, where appropriate, an in-app notice. Continued use after changes take effect means you accept the updated Terms.
A specific governing law and venue will be designated when these Terms are finalized for general availability. Until then, these Terms are governed by the laws applicable in the provider's place of residence, without regard to conflict-of-laws rules, except where prohibited by applicable law.
